<p>In 2012 and 2013, AzAA was successful in passing legislation which requires one state certification (or license) for an alarm company as opposed to allowing each city to require everyone in the industry be licensed. Under this legislation, we cut the number of criminal background checks and licenses many companies were required to obtain. Below are summaries of both bills, although the 2013 legislation will not become law until 90 days after the state legislature adjourns (there is no certain date as to when they will adjourn). Those sections of the law are marked.</p>
<p>Alarm Companies</p>
<ul>
	<li>“Alarm Business” is defined as any person who, either alone or through a third party, engages in the business of either: (1) providing alarm monitoring services, or (2) selling, leasing, renting, maintaining, repairing or installing a nonproprietor alarm system or service. It does not include a person involved with alarms affixed to motor vehicles or the installation of fire alarm systems.</li>
</ul>
<ul>
	<li>All Alarm Businesses must be either licensed by the Arizona Registrar of Contractors or have a certificate from the Arizona Board of Technical Registration (BTR) beginning October 1, 2013. The BTR is accepting applications for certification (go to <a href="http://www.azbtr.gov">www.azbtr.gov</a>). BTR certificates are valid for two years.  At this time, BTR is not accepting for those companies who have an ROC license.  There will be more information coming for those companies soon.</li>
</ul>
<ul>
	<li>All Alarm Businesses must appoint a “controlling person”, a person who is designated by an alarm business, as their contact person for the BTR. This person must submit fingerprints and pass a criminal background check done by BTR. Under the 2013 legislation passed, if the controlling person is already certified as an alarm agent, they do not need to submit fingerprints again for the purpose of becoming a controlling person (just paperwork).</li>
	<li>Cities, towns and local jurisdictions can no longer require licensure of alarm companies and agents, however companies may be required to obtain business licenses in some jurisdictions.</li>
	<li>  A separate Alarm Business Certificate is required for each business name, except one certificate may be used for two businesses with the same ownership.</li>
</ul>
<p>Alarm Agents</p>
<ul>
	<li>“Alarm Agent” is defined as a person, whether an employee, an independent contractor or otherwise, who acts on behalf of an alarm business and who tests, maintains, services, repairs, sells, rents, leases or installs alarm system. It does <strong>NOT</strong> include any action by a person that (1) is performed in connection with an alarm system located on the person’s own property or the property of the person’s employer; or (2) is acting on behalf of an alarm business whose work duties do not include visiting the location where an alarm system installation occurs (Note: these two exceptions were added in 2013).</li>
	<li>All Alarm Agents must be certified by the BTR as of October 1, 2013. In order to do this, the alarm agent must submit fingerprints and the required fee. The certificate is valid for two years (go to <a href="http://www.azbtr.gov">www.azbtr.gov</a> for applications).</li>
	<li>A person must apply for an alarm agent certificate within five working days after being employed by an alarm business. They may not work as an alarm agent until the application is processed and approved unless under the direct supervision of a certified alarm agent. The Board of Technical Registration must issue or deny an alarm agent certification card or a renewal certification card within ten business days after receiving the application.</li>
	<li>An alarm agent shall physically possess their agent certification card when performing or authorizing the performance of any task of an alarm agent.</li>
	<li>The alarm agent’s certificate card is the personal property of the person to whom it is issued.</li>
</ul>
<p><em>Criminal Background Checks </em></p>
<p>The Board of Technical Registration will keep the fingerprint cards on file and annually run a criminal background check through the Arizona Department of Public Safety and FBI on all controlling persons and alarm agents. If a person has been convicted of theft, burglary, robbery or armed robbery, criminal trespass, abuse or sexual abuse of a vulnerable adult, sexual assault, any offense involving the exploitation of a minor, molestation of a child, homicide (including first or second degree murder and negligent homicide), distribution or manufacture or sale of marijuana or dangerous drugs or narcotic drugs less than three years before the date of applying for certification, kidnapping, or fraud by persons authorized to provide goods or services, certification will be denied. A person can appeal a denial of certification within 30 days after receiving notice from the Board of Technical Registration.</p>
<p><em>Violations</em></p>
<p>For persons not properly certified by the Board of Technical Registration, the Board can ask the state Superior Court for an injunction to stop any person from doing business, can initiate hearings on receipt of complaints and/or can impose a civil penalty of no more than $2,000 per violation. If a person fails to pay any civil penalty, the Board can turn the information over to the state Attorney General to commence a civil action.</p>

<p>House Bill 2748 was passed in 2012 and requires certification by the State Board of Technical Registration of all companies and persons who engage in selling, leasing, renting, maintaining, repairing or installing non-proprietor alarm systems or service and/or provide alarm monitoring services by October 1, 2013 (the Board will begin issuing certificates on May 1, 2013).  This does <em>not </em>include installation or monitoring of fire alarm systems, motor vehicle alarms or any alarm system operated by a city or town.</p>
<p>Cities, towns and counties will no longer be allowed to require alarm business or alarm agent (technician) licensure after October 1, 2013.</p>

<p>Tucson has adopted a new alarm ordinance which requires licensure of alarm companies: $20 annual registration of alarm users (can be done on-line); monthly reports from each alarm company regarding their customer base (see attached) in an Excel spreadsheet or MS Access which can be saved electronically on a CD or DVD and mailed to the police alarm unit, downloaded by the Police Department on an FTP server hosted by the alarm company or for smaller reports, can be emailed to TPDAlarms@tucsonaz.gov; and false alarm assessments as opposed to civil penalties. <a href="http://azalarms.org/?attachment_id=3705">Click here for Data Template</a></p>

<h1>Arizona Alarm Coordinators Page</h1>
<p>The following information was contributed on 7/20/07</p>
<p>I found a web site that has several articles about alarm ordinances and other legislation effecting the alarm industry. For example, <a href="http://www.securityinfowatch.com/article/standards.jsp?siteSection=320" target="_blank">this site</a> has several articles about alarm ordinance issues in other states. <a href="http://www.isc365.com/home.aspx" target="_blank">The ISC365 site</a> is another good site with articles on new technology. I recently sent a group e-mail to the Phoenix Metro area alarm coordinators with information about the security fog systems from this site. Other Links for alarm industry associations such as CSAA, NBFAA, SIAC, etc. I found the ANSI/SIA MSD-01-2000 Mobile Security Device Standard online at CSAA. This issue is definitely a concern to alarm coordinators who do not have anything in their ordinance to regulate MSD&#8217;s. I feel that something like this would be helpful and also a way for the association to reach out to the alarm coordinators.</p>

<p><br />The Arizona Alarm Association realizes the value in maintaining open communication between the alarm companies and the alarm coordinators for all of the jurisdictions throughout Arizona. In order to accomplish this, AzAA formed a Public Safety Committee in 1989. This Committee meets quarterly in various locations throughout the state, and all alarm coordinators and AzAA members are encouraged to participate.</p>
<p>Accomplishments of the Public Safety Committee include:</p>
<ul>
	<li>Communication between alarm coordinators and alarm companies on various issues including what should be included in alarm ordinances, false alarm reduction techniques, and mobile and personal alarms.</li>
	<li>False Alarm Schools.</li>
	<li>A manual of the alarm ordinances of all jurisdictions throughout the state.</li>
	<li>A Partnership Program, under which each jurisdiction is partnered with an alarm company so they can work together to develop ways of reducing false alarms in their specific jurisdiction.</li>
	<li>A reciprocal licensing ordinance, which the jurisdictions are encouraged to adopt. This allows a jurisdiction to recognize an alarm company and alarm agent license issued by another jurisdiction.</li>
	<li>An annual Public Safety Days two-day workshop for alarm coordinators and alarm companies which provides indepth updates on various issues of concern.</li>
	<li>An alarm resource directory, listing all alarm companies and their contact persons.</li>
	<li>An alarm installation guide.</li>
	<li>A brochure regarding training alarm salespeople.</li>
</ul>
<p>In recognition of the alarm coordinators, AzAA holds an annual Public Safety Appreciation Dinner each September. This provides an excellent opportunity for alarm coordinators, their Chiefs of Police or Sheriffs, and alarm companies to discuss issues of concern.</p>
